The Data Protection Act 1998 came into effect in 2000 and gives individuals a right to access information held about them by adult social care providers.The Computer Misuse Act 1990 was introduced to protect against a range of offences relating to computer records which social care providers hold of individuals in care settings.The Freedom Of Information Act 2000 gives everyone a right of access to all types of recorded information held by public authorities.The Human Rights Act 1998 include the rights to privacy and security of information and of private correspondence.The Health and Social Care Information Centre provides advice to health and safety care organisations under the health and safety care act 2012on how to handle confidential information.
1.2 Explain how legal requirements and codes of practice inform practice in handling information?
When handling information about service users they must know who and why the information is being shared and must only used for the reason given under the Data Protection Act 1998. The key points of handling information are that data is collected with individual’s consent. To be used on a need to know basis and used for the required purpose only. The data needs to be accurate,up to date and kept private. Data should be treated confidentially and respected. We should never anonymise data. Data should be restricted to who has access to it and kept safe and secure.
3.1 Explain how to support others to understand the need for secure handling of information?
There is two types of people to support when it comes to handling data these are colleagues and service users. For colleagues you have to set a good example,provide information and guidance on relevant legislation and codes of practice and the consequences of not complying with these. I would use the colleagues induction to guide them through the companies policies of handling data. For service users I would use simple and concise wording that they would understand and talk about their rights and responsibilities as a person and how we keep and secure their information and who has the right to see this information.
3.2 Explain how to support others to understand and contribute to records?
Again this is split into two parts the service users and staff,the service users will need easy read forms so they can understand and follow what is being written. Preparing records in different formats like Makaton signs and using easy visuals that they understand. Supporting colleagues when a new way of working is introduced needs to be understood by all staff and to be maintained consistently by every part of the team.communicating any new changes should happen immediately so all the team are aware of the changes.
2.1Explain how to maintain records that are up to date, complete, accurate and legible?
Maintaining up to date,complete,accurate and legible records is crucial to delivering good quality, safe and effective care, as well as complying with the relevant legislation and codes of practices.These are some good practices for maintaining records, they need to be up to date and written as soon as you can so you can include all the information and to only contain current information and to update regularly as needed. Complete all parts of the records as necessary and include time and date and all people involved if needed. The records have to be accurate and containing only information that relates to the facts of what has taken place. The records have to be legible and written in ink and clearly written so others can read the records and for them to understand the information. Any alterations need to be dated and signed that these changes are true.
2.2Describe practices that ensure security when storing and accessing information?
To ensure security of paper based records you must make sure they are locked in filing cabinets and remains secure at all times. Returning records to the right place as soon as you have finished with them and not so others can get hold of them. Accessing them by the people they are meant to be seen by only. When storing electronic records clearly labelled documents and files will allow important information to be retrieved quickly when needed. When accessing electronic records it is important in order to prevent unauthorised access that you keep your login and password details secure and that you do not share these with others.
2.3 Describe features of manual and electronic information storage systems that help ensure security?
Filing systems for paper based records should include procedures for records to be signed out when accessed and signed back in when returned, so that access is limited only to those who have authorisation. Using a alphabetical way of filing will reduce files being mislaid. Electronic systems must include secure logins and passwords for staff who need to access documents and files. Passwords should be changed on a regular basis. Using screen savers will protect information if away from the computer for some time. Logging out when you have finished looking at documents or files.
